Terms of service

DermNurse Medical Aesthetics

Terms of Service

Effective Date: October 8, 2026

These Terms of Service govern your use of the DermNurse Medical Aesthetics website, online store, and online skincare questionnaire, and your purchases of products from DermNurse. In these Terms, “DermNurse,” “we,” “us,” and “our” refer to DermNurse Medical Aesthetics, and “you” refers to the person using the website or purchasing products.

Please read these Terms before using our online services or placing an order. By accepting these Terms at checkout or when otherwise presented for acceptance, you agree to them. If you do not agree, do not place an order or use services requiring your acceptance. Nothing in these Terms removes rights or remedies that cannot be excluded under applicable law.

1. Scope and Related Policies

Our Return & Refund Policy forms part of the terms of your product purchase. Any shipping terms and promotional conditions disclosed before you complete your order also apply. Our Privacy Policy explains how we handle personal information.

If these Terms and the Return & Refund Policy differ on a return or refund issue, the Return & Refund Policy controls, subject always to applicable law. The terms disclosed when you place an order apply to that order.

These Terms do not replace separate clinical consent forms, treatment agreements, or appointment policies. Booking or receiving a clinical service may require separate assessment and consent. Purchasing a product does not include a clinical consultation unless expressly stated.

2. Eligibility and Account Information

To place an order, you must have reached the age of majority where you live and have legal capacity to enter into a contract, or have a parent or legal guardian place the order on your behalf. Product suitability for a minor must be assessed separately from eligibility to purchase.

Provide accurate, current contact, billing, delivery, and account information. You must be authorized to use the payment method you provide. If you create an account, keep your login information secure and promptly notify us of suspected unauthorized use. You are responsible for activity you authorize through your account, subject to applicable law.

3. Skincare Information and Questionnaire

The DermNurse Skincare Questionnaire gathers information about your skin concerns, sensitivities, relevant medical history, current skincare routine, and personal goals. This information helps guide personalized skincare recommendations and identify potential concerns or precautions.

Our website content, questionnaire, and automated recommendations support informed purchasing decisions. They are not a medical diagnosis, prescription, or substitute for an individualized clinical assessment. Completing a questionnaire or purchasing a product does not, by itself, establish a clinician–patient relationship or guarantee that a clinician has reviewed your responses.

We strongly encourage you to complete the questionnaire and consult a qualified clinician before purchasing professional skincare products. Recommendations depend on the accuracy and completeness of the information you provide and may not identify every relevant condition or interaction. Tell your clinician about relevant changes before relying on earlier recommendations.

4. Product Suitability and Safe Use

Review product ingredients, directions, warnings, and contraindications before purchase and use. Follow the manufacturer’s instructions and seek individualized advice if you are uncertain about suitability, including during pregnancy or breastfeeding, when taking medication, or when managing a skin condition or allergy.

Individual results vary. Product descriptions, photographs, testimonials, and recommendations do not guarantee a particular result. Ingredients and packaging may change; check the label on the product supplied and contact us if it differs materially from what you ordered.

If you experience an unexpected reaction, discontinue use immediately and contact DermNurse. For a severe reaction, seek immediate medical attention. Our website, questionnaire, and email are not emergency services. Return eligibility for adverse reactions is addressed in our Return & Refund Policy.

5. Products Prices and Promotions

Products are subject to availability. We may change our range, limit quantities for reasonable purposes such as preventing fraud or unauthorized resale, or discontinue products. We will not use these measures to avoid our obligations for accepted orders.

Prices are in Canadian dollars unless clearly stated otherwise. Applicable taxes, shipping charges, and other disclosed charges will be shown before you submit your order. Promotional eligibility, exclusions, expiry dates, and any conditions affecting a refund must be disclosed with the offer.

Price changes apply to future orders. If we discover a material error affecting an order, we will contact you to explain it and seek your agreement to any proposed change, or cancel and refund the affected order where permitted by law. We will not charge you a higher price without your agreement.

6. Orders and Payment

Review the products, quantities, delivery details, and total price before submitting your order. An automated receipt acknowledges that your order has been received. We accept an order when we confirm acceptance or dispatch the products, whichever happens first, subject to applicable law.

We may decline an order before acceptance for a legitimate reason, including unavailable stock, unsuccessful payment, suspected fraud, or a delivery destination we cannot serve. We will notify you and promptly refund any payment collected for products we will not supply. We will not make a material substitution without your consent.

Payment is processed through the payment options offered at checkout. You authorize collection of the total amount you approve. We will provide an order record or confirmation that you can retain. Contact us promptly if you notice an error or need to request a change or cancellation. We will accommodate requests where possible; your statutory cancellation rights remain unaffected.

7. Shipping and Delivery

Available delivery destinations, shipping charges, and estimated delivery information are provided during checkout or in the shipping information presented before purchase. Please supply a complete and accurate address. We will communicate material delivery delays when we become aware of them.

Delivery estimates are not guaranteed unless expressly stated, but they do not override mandatory delivery or cancellation rights. If an order is missing, damaged, or marked delivered but not received, contact us so we can investigate and arrange the remedy required by the circumstances and applicable law.

As described in our Return & Refund Policy, orders refused upon delivery or returned because of incorrect shipping information or failure to collect may be subject to a 20% restocking fee plus applicable shipping costs. This applies only where disclosed before purchase and permitted by law. It does not apply to an error by DermNurse or its shipping provider, or to the lawful exercise of a statutory cancellation right.

8. Returns Exchanges and Refunds

Our Return & Refund Policy sets out the complete requirements and exceptions. The following key terms apply to eligible product returns:

Request a return within 30 days after receiving your order and obtain authorization before sending products back. Provide proof of purchase and the reason for the return.

Unopened and unused products must be in their original packaging with protective seals intact. No restocking fee applies to these product returns.

Opened or lightly used products must have at least 75% of their original contents remaining. The fee per approved opened-product return is the lesser of $25 and 20% of the product’s original purchase price before taxes.

No restocking fee or return shipping charge applies to products that are defective, damaged during shipping, or incorrectly supplied, or where prohibited by law.

Approved refunds are issued to the original payment method within 10 business days. Your payment provider may need additional time to post the refund.

Customers generally pay return shipping, and original shipping charges are generally non-refundable, subject to the exceptions in the Return & Refund Policy and applicable law. Exchanges are subject to approval and availability. Final sale items, gift cards, promotional gifts, and other exclusions are addressed in that policy.

Any lawful statutory cancellation, warranty, refund, or other remedy is separate from our voluntary 40-day return policy. A restocking fee, return condition, or exclusion will not restrict such a remedy. Contact manager@dermnurse.ca to request assistance.

9. Privacy and Electronic Communications

We handle personal information in accordance with applicable privacy law and our Privacy Policy. Questionnaire responses and skin photographs may include sensitive health information. Review the privacy notice provided when information is collected, and submit only information you are authorized to provide.

Accepting these Terms does not constitute blanket consent to unrelated uses of your information or to marketing. We will obtain any consent required by law for collecting, using, or disclosing your information. Requests about access, corrections, or privacy may be sent to info@dermnurse.ca.

We may send communications needed to process your order, respond to your request, or provide a service you have requested. Promotional communications are subject to applicable consent and unsubscribe requirements. Withdrawing marketing consent does not prevent necessary order or service communications.

10. Acceptable Website Use

You may use our website for lawful personal purposes and legitimate purchases. You must not:

Provide fraudulent payment information, impersonate another person, or submit information you have no authority to share.

Attempt unauthorized access to accounts, systems, or personal information.

Introduce malicious software, disrupt the website, or bypass security measures.

Use website content or services to infringe intellectual property, privacy, or other legal rights.

Send unlawful, threatening, harassing, or deceptive content through our services.

We may restrict access where reasonably necessary to address a breach, suspected fraud, or a security risk. Any restriction will not extinguish your rights concerning an existing purchase, refund, or personal information.

11. Intellectual Property and Customer Feedback

Website text, photographs, graphics, logos, and other materials belong to DermNurse or their respective owners. You may view them for personal use and retain copies of your order records and the terms governing your purchase. Other reproduction or commercial use requires permission unless permitted by law.

If you submit a review for publication, you retain ownership and give DermNurse a non-exclusive permission to display it with that product or service and make formatting edits that do not change its meaning. You must have the right to submit it. We may remove unlawful, misleading, abusive, or privacy-infringing reviews.

Private questionnaire responses, clinical information, skin photographs, and support correspondence are not public reviews. These Terms do not authorize their use in advertising or testimonials. Any such use requires separate permission where required by law.

12. Third Party Services and Links

Our online store uses Shopify and may use other providers for functions such as rewards systems,  payment processing and delivery. Their services may be subject to additional terms presented to you. DermNurse remains responsible for its own obligations to you under your purchase contract and applicable law.

Links to external websites are provided for convenience. We do not control their content or privacy practices. Review their terms before using them. A link does not guarantee the accuracy of external information or the suitability of an external product or service.

13. Website Availability and Liability

We take reasonable care with our website and product information, but cannot promise uninterrupted access or that every technical error will be prevented. We may carry out maintenance or correct errors. This does not exclude obligations concerning accurate product information, accepted orders, or remedies required by law.

To the extent permitted by applicable law, DermNurse is not responsible for adverse skin reactions, product incompatibility, or unsatisfactory results arising solely from your independent product selection or improper use. Completing the questionnaire does not constitute a medical consultation or guarantee product suitability.

Nothing in these Terms excludes or limits DermNurse’s legal responsibilities for defective products, negligence, inaccurate or misleading product information, fraud, privacy obligations, or any liability that cannot lawfully be excluded. No provision waives mandatory consumer warranties, statutory remedies, or rights arising from an actual clinical relationship.

14. Governing Law and Resolving Concerns

These Terms are governed by the laws of Alberta and the federal laws of Canada applicable there, subject to any mandatory protections of the province or territory where you live that apply to your transaction.

Please contact info@dermnurse.ca with concerns so we can try to resolve them. Contacting us first is encouraged but is not a condition of exercising a legal right. These Terms do not require mandatory arbitration, waive participation in a class proceeding, prevent complaints to a regulator, or remove your right to bring a claim in a court with jurisdiction under applicable law.

15. Changes and General Provisions

We may update these Terms for future use of our services. We will post the revised version with its effective date and provide additional notice or obtain consent when required by law. Changes will not retroactively alter an existing order or accrued rights without your agreement where required.

If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion does not waive the right to enforce it later. These Terms and the purchase conditions disclosed to you form the agreement for the matters they address, without excluding representations or rights that applicable law protects.
